Arcor Inc has spent over 20 years helping a variety of businesses, including gas stations, become ADA Compliant and become less of a target for ADA Lawsuits. The ADA now requires that all operable parts of a gas pump be at or below 54 inches above the driving surface. Any new construction must have these parts at no higher than 48 inches above the surface. The operable parts are fuel grade selection buttons, credit card readers and help buttons. Access to any shop, checkout counter, office, eating facilities or restrooms at the gas station, must also be accessible and comply with ADA guidelines. The attendant may be required to provide assistance at a self-service pump, or a full-service pump. The disabled customer must always pay the self-service price.
No Businesses are exempt from the ADA California Building Codes, and both state and federal ADA Laws apply. Gas stations are required to comply with Title III of the ADA. This provision prevents discrimination against customers with disabilities and requires businesses to provide accommodations that improve accessibility and participation for disabled customers.
