FAQ About CASp Certification

Yes. Unlike most certificates, a CASp certification was created to help business owners working toward compliance, as achieving full compliance often doesn’t happen overnight—especially given the frequency of lawsuits. The certification shows good faith effort, which can provide legal benefits and help reduce liability while you make necessary upgrades.

A CASp certification does not expire, but its validity depends on maintaining compliance. Regular updates every 3–5 years or after renovations help ensure your property meets current ADA standards.

Keeping an updated report also provides documented proof of compliance, which can be crucial if you’re ever sued. In mediation, having substantiated evidence of completed work can reduce liability and potentially dismiss claims related to already addressed violations.

Even if you believe you’re compliant, a CASp inspection provides legal protection. Drive-by lawsuits happen regardless of actual compliance, but having a CASp Certification serves as verified proof, helping deter frivolous claims and strengthen your defense in mediation.

Missing a small detail—like an accessible entrance sticker that costs just $5—might not seem like a big deal, but if you don’t realize it’s missing, it could lead to a $4,000 lawsuit. A CASp inspection helps catch these small but costly issuesbefore they turn into expensive legal problems, giving you the chance to fix them and reduce your risk of lawsuits.

While California accounts for a large share of ADA lawsuits, federal ADA regulations apply in every state and legal action can be taken anywhere.

That’s why it’s still critical to get an accessibility report, even outside California.

Once the property is brought into full compliance with applicable federal (ADA) and state (CBC/Title 24) standards, the CASp can certify it as compliant. The CASp updates the report to show that the site is “CASp Inspected and Determined to Meet Applicable Standards.”
